1. Agreement to Terms

By accessing or using Vizcraft ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Vizcraft provides AI-powered architectural visualization tools that allow users to generate, enhance, and transform architectural images using artificial intelligence technology.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Accept all responsibility for activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to use the Service. Users under 18 must have parental consent.

4. AI-Generated Content and Ownership

4.1 Your Content

You retain all rights to the images you upload to the Service ("Your Content"). By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free license to process, store, and display Your Content solely for providing the Service.

4.2 AI-Generated Content

Subject to your payment of applicable fees and compliance with these Terms, you own the AI-generated visualizations created through the Service ("Generated Content"). However, you acknowledge that:

  • Generated Content may not be eligible for copyright protection in all jurisdictions
  • Similar or identical content may be generated for other users
  • We retain the right to use anonymized or aggregated data for improving our AI models

4.3 License to Use Generated Content

You may use Generated Content for any lawful commercial or personal purpose, subject to the Acceptable Use Policy below.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, or discriminatory
  • Violate any intellectual property rights or privacy rights
  • Upload images containing illegal content or content you do not have rights to use
  • Attempt to reverse engineer, decompile, or extract our AI models
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without authorization
  • Generate content intended to mislead or deceive others
  • Resell or redistribute the Service without authorization

6. Credits and Payment

6.1 Credit System

Certain features require credits. Credits are non-refundable and non-transferable. Unused credits may expire according to your subscription plan.

6.2 Pricing and Billing

All fees are in U.S. dollars unless otherwise stated. You agree to pay all applicable fees for your subscription plan. We reserve the right to change our pricing with 30 days' notice.

6.3 Subscriptions

Subscriptions automatically renew unless canceled before the renewal date. You can cancel your subscription at any time through your account settings. No refunds will be provided for partial subscription periods.

6.4 Refund Policy

Credits and subscriptions are generally non-refundable. We may provide refunds at our sole discretion in cases of service failure or billing errors.

7. Service Limitations and Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Accuracy or quality of AI-generated content
  • Uninterrupted or error-free service
  • Fitness for a particular purpose or non-infringement
  • That Generated Content will meet your specific requirements

AI-generated results may vary and are not guaranteed to be accurate, professional-grade, or suitable for any specific purpose. You are solely responsible for evaluating and using Generated Content.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIZCRAFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Vizcraft and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from: (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any rights of another.

10. Third-Party Services

The Service integrates with third-party AI providers. Your use of these integrated services is subject to their respective terms of service and privacy policies. We are not responsible for the performance, availability, or policies of third-party services.

11. Account Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Non-payment of fees

You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease.

12. Data Backup and Loss

While we implement backup procedures, we are not responsible for any loss of Your Content or Generated Content. You are responsible for maintaining your own backups of important content.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
